The Senate can resume work when lawmakers return, but the bill would face tougher negotiations, a 60-vote procedural hurdle, and more pressure to rewrite disputed sections. In the meantime, U.S. crypto regulation would remain fragmented, with the SEC and CFTC still operating without a fully unified market structure law.

    Why Missing the Senate Recess Does Not Kill the CLARITY Act

    Failing to pass the CLARITY Act before recess would be politically disappointing, but it would not automatically end the bill. Once a bill is already in the Senate pipeline, missing a short-term deadline usually means the chamber returns to it later rather than starting over from scratch.
